GPC decision No. (443) for 2006 regarding some rules related to foreign companies working in Libya.

It has been decided :
Article (1)
Effective from issue of this decision, practicing economical activity for normal and important foreign persons in Libya to execute public productive projects, or practicing general contracting, building and construction works in fields stipulated in article (2) of this decision, will be through sharing with one of national public or private economical activity in field of specializations, and by establishing common joint stock companies according to effective legislation.
Article (2)
The practiced projects or works by normal or important foreign persons should be according to previous article, technique transmission or employing or training national labor and qualification or to practice joint investment in the following fields:
A- Field of contracting and civil works including activity of building and construction.
B- Field of electricity.
C- Oil services (( in fields of catering, maintenance, transport, equipments, wells services and manufacturing of requested materials for excavation and exploration)).
D- Field of transportation and communication.
E- Field of industry, agriculture, animal and marine wealth.
Rules of article (1) of this decision is effective to all works and existing projects in time of this decision’s issue, except contracting projects for execution with foreign companies from date of effectiveness of this decision which their execution continue according to signed contracts.
Article (3)
Exception rules of article (1) of this decision, it is allowed to contract for execution of private proprietary projects as site or specification or requirement of execution according to issued permissions by GPC.
Article (4)
Normal or important foreign persons in Libya will practice other economical activities in field of professions, craft and investment in service and production field according to systems and principles stipulated as per effective legislations regarding these activities, that including rules of organizing legislation for foreign investment according law No.(5) for 1997 and law No.(7) for 2004.
Article (5)
To grant common joint stock companies that will be established to execute rules of article (1) of this decision the concessions and certified incentives for national companies in particular :
A- Right to exploit lands, establish factories and needed workshops.
B- To get financial and credit facilities from the banks.
C- To provide non national labor to serve their projects in works and professions which can not be practiced by Libyans.
Article (6)
Rules of this decision do not contradict opening representative offices for foreign companies in Libya according to decision of secretariat of GPC No.( 89) for 2006.
Article (7)
Rules of financial treatment are applied for national labor working in foreign and common companies as foreign labors in those companies.
Article (8)
To cancel any rules contradicting this decision.
Article (9)
This decision comes into effective from its issue, to be executed by concerned authorities and published in code of procedures.
