Decree (No. 315/2008) has been issued by the General Popular Committee to reorganize commercial representations. 

Specifically Article 1 of the said Decree, importation of every good and service has to be through one distributor or more and one distributor agent or more in the Cities of the Great Jamahiriya as per the population of each city.

It is conditioned that the relation with the producer of the good or the provider of the service or their main distributor is direct.

The Ministry of Economy, Trade and Investment shall fix the minimum number of distributors and distributor agents in each city.         

According to Article 2 of the said Decree, commercial distribution regarding the goods listed hereunder must be carried out by distributor or more and distributor agent or more for only one Trademark of the Trademarks of the following four categories:

  1. Heavy duty machinery equipments and instruments
  2. Road and quarry equipments.
  3. Cars trucks and buses.
  4. Machinery for use in the agriculture sector.

The distributor is committed to provide after sale services especially providing spare parts and maintenance services. 

Article 2: lists fifteen categories of goods for which commercial distribution must be carried by distributor or more and distributor agent or more for only one Trademark in each category not exceeding three commercial representations  of the following goods:

  1. Equipments used for diagnose and treatment in the medical sector.
  2. Stationeries and office equipments;
  3. Electric goods for house use;
  4. Electric goods for purposes other than home use;
  5. Electronic equipments for all purposes;
  6. Tools and machinery for use in workshops;
  7. ight machinery for use in the agriculture sector;
  8. Materials and primary goods for use in the agriculture sector;
  9. Medicine and medical care goods, except vaccines which are imported by public companies;
  10. Tools and instruments for photography;
  11. Boats, yachts and fishing vessels of any kind;
  12. Fishing tools and equipments; and
  13. Equipments and tools for bakery use.

Article 4: The Ministry of Economy, Trade and Investment shall determine the foods and building material which could be imported directly by the interested without the need for distributors.

Article 5: it is not allowed for whom manages a governmental authority or his relatives up to the forth degree to practice distribution of goods which such governmental authority supply or connected to its business.
